Application for a lawful development certificate proposed for the proposal is for the change of use of the subject property to a single dwellinghouse (Use Class C3).The Local Planning Authority?s delegated report for application 25/02618/CLE concluded that the property was not in C3 use but noted the existence of a House in Multiple Occupation licence. This application seeks formal confirmation that the proposed reversion to a single-family dwelling constitutes permitted development. The property has been let since 2013 to four joint tenants. HMO licences were issued in 2018 and 2023. A previous application decision dated 20/01/25 determined that the "application certificate existing for the use of the property as a single dwelling (Use Class C3) is NOT LAWFUL. The purpose of this application is to regularise the future use as use class C3 as a family home under permitted development. The property is being purchased by a family as their home and they wish to have confirmation that the proposed use class C3 is legal.
